The Fair Debt Collection Practices Act (FDCPA)

The Fair Debt Collection Practices Act

Stop Harassment  |  Sue Debt Collectors  |  FDCPA

Protecting the Rights of Consumers Like You

The FDCPA controls what actions debt collectors can take when attempting to collect a debt. If you are being harassed by a debt collector or the debt collector is acting inappropriately, you may be entitled to sue the debt collector. For example, debt collectors must identify that they are trying to collect a debt, and they must inform you that you can dispute the debt that they are trying to collect. If you dispute the debt in writing, they must stop collection efforts until they can verify the debt. Additionally they cannot do any of the following:

- Misrepresent the amount of the debt;
- Threaten any legal action that they do not intend to take;
- Imply that you will be arrested if you do not pay;
- Contact you if you ask them to leave you alone or if you tell them you have a lawyer;
- Tell other people about your debt; or
- Use any deceptive means to try to collect a debt from you.

This list is just the beginning. There are countless other behaviors that the law prohibits. If you receive any letters or phone calls from debt collectors, our FDCPA lawyers can review your case for free and tell you if you have a FDCPA claim against your creditors. These cases can be filed at no cost to you.
